Suffolk County DWI Attorney Jason Bassett Explains the Differences Between a DWAI, DWI, and a DUI

The lawyer explains that DWI stands for “driving while intoxicated” and DUI stands for “driving under the influence”. Oftentimes, people use DUI and DWI interchangeably but the legal terms vary from one state to another. If someone is driving with at least 0.08% BAC, they are considered too intoxicated to legally drive.

Attorney Jason Bassett mentions that DWAI stands for “Driving While Ability Impaired”. There are three types of DWAI. These types are DWAI/Alcohol, DWAI/Drug, and DWAI/Combination. DWAI/Alcohol happens when a driver is driving with a BAC between 0.05 and 0.07. DWAI/Drug is when a driver is driving while ability impaired by a single drug other than alcohol.

In the article, attorney Bassett says that violating the laws against driving under the influence of alcohol and drugs can be punished with a suspended or revoked driver’s license, fines, and even a potential jail sentence. The penalties depend on the severity of the DUI and whether or not it is the first offense.

The lawyer also adds that in New York, DWAI is short for “Driving While Ability Impaired”. There are three different kinds of DWAI in the state of New York and each of these types has its own potential consequences.
